HOW TO VOTEThere are two (2) potential ways for you to cast votes for the Awards – “American Music Awards Website Voting” and “Instagram Comment Voting,” both of which are described below:

  • American Music Awards Website Voting:  During the Voting Period, you may use your computer, tablet, or mobile device, open your preferred internet browsing application, and go to vote.theamas.com (“American Music Awards Voting Page”) to submit your votes (“American Music Awards Website Voting”).
  • When you arrive at the American Music Awards Voting Page, the first Award will be expanded for you to vote in. You can view the nominees for any of the Awards by expanding and collapsing the navigation bar with the Award name.
  • On each Award section of the American Music Awards Voting Page, you will see the name, description (if applicable), and photograph for each nominee for that Award. Clicking on a nominee image will expand the nominee card. You can vote for a nominee by clicking the + or – buttons to allocate the number of votes you wish to submit and clicking “Vote.”  You will be notified of the number of votes remaining (within the nominee and/or across Awards).
  • To vote via American Music Awards Website Voting, you must have a valid Facebook or Google account. If you are not already signed into your Facebook or Google account, when you click on the “Vote” button, you will be directed to register using your valid Facebook or Google account. You will need to enter your e-mail address and password to log in to either Facebook or Google, as you may select, and accept these Rules, the Terms of Use and the Privacy Policy. Votes on the American Music Awards Voting Page must be made by the authorized Facebook or Google account holder.
  • If you do not currently have a Facebook account or a Google account, you will not be able to vote via American Music Awards Website Voting unless you register for a Facebook account (go to Facebook.com or download the Facebook application to register) or a Google account (go to Google.com or download the Google application to register).Registration for Facebook and Google is free at the time of publication of these Rules.
  • You will be prompted to accept either the Facebook or Google access authorization application (“Access Authorization”) the first time you vote, depending on whether you registered with your Facebook or your Google account. You must accept the applicable Access Authorization in order to vote at the American Music Awards Voting Page.
  • After submitting all available votes for an Award, the next Award will automatically expand to display the nominees for that Award and the previous Award will be collapsed. After you have submitted all available votes for all Awards, you will see a “Thank You” page that offers you the opportunity to share your vote to your Facebook profile or X (formerly Twitter) timeline, or return to the American Music Awards Voting Page. Sharing your vote to your Facebook profile or X timeline will NOT count as an additional vote.
  • Instagram Comment Voting:  During the Voting Period, you may also vote on Instagram by mentioning specific hashtags (as described below) in a comment posted on the call-to-action “Official Voting Post(s)” from the American Music Awards Instagram account (https://www.instagram.com/amas/) (“Instagram Comment Voting”).
  • To vote via Instagram Comment Voting, you must have a valid Instagram account and be logged into Instagram, and your Instagram account must be set to public to vote. Instagram comments from private Instagram accounts will not be recognized or counted as votes. Instagram votes must be made by the authorized Instagram account holder.
  • If you do not currently have an Instagram account, you will not be able to vote via Instagram Comment Voting unless you register for an Instagram account (go to Instagram.com or download the Instagram application on your mobile device to register). Registration for Instagram is free at the time of publication of these Rules.
  • You may vote via Instagram Comment Voting by posting a comment on the Official Voting Post(s) during the Voting Period. Your comment on the Official Voting Post(s) must contain the specific hashtag announced for the Award and nominee you wish to vote for (each, a “Promoted Hashtag”):
  • The Promoted Hashtag includes the applicable nominee(s) and specific Award for which you are voting. This single hashtag includes the Award name or abbreviation and the name of an artist, the name of a song, or the name of an album.
  • The list of Promoted Hashtags in the format specified above is linked here.

Examples of a valid vote via Instagram Comment Voting would be:

I’m voting for #aotybadbunny

Or

  • Instagram Comment Voting that complies with the foregoing instructions will be counted as valid votes. Only votes posted on the Official Voting Post(s) will be counted. If more than one (1) designated nominee hashtag or Award hashtag is contained in a comment, the comment will be considered invalid and none of the votes in that comment will count. Instagram Comment Voting must comply with all other Instagram requirements and may not include any derogatory, defamatory, or obscene language or images. RELEASE AND LIMITATION OF LIABILITY:  You participate in this voting process at your own risk. By participating in the vote for one (1) or more Awards, you agree to release and hold harmless Producer, Penske Media Corporation, CBS Broadcasting, Inc., Paramount Global, Telescope Digital Inc. and each of their respective parent, subsidiary, and affiliate entities, suppliers, licensees, distributors, and assigns, and  each of the foregoing’s officers, directors, members, managers, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, without limitation, personal injury, death, or damage to or loss of property, arising out of or in connection with your participation in the voting process and/or in any way related to the Awards or the Program.

Without limiting the foregoing, by participating in the voting process, you agree that the Released Parties are not responsible and shall not be liable for: (i) any incorrect or inaccurate information provided in connection with these Rules, the Awards and/or the Program, including, without limitation, any incorrect or inaccurate information that is the result of any printing or typographical errors or by any of the equipment or programming associated with or utilized in any of the voting methods, whether caused by Producer, platform providers, voters or otherwise; (ii) technical or service failures of any kind, including, without limitation, malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) unauthorized human intervention in any part of the voting process; (iv) technical or human error which may occur in the administration of the voting process or the counting of votes; or (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from your participation in the voting process.

GENERAL TERMS: Producer reserves the right, in its sole discretion, to (i) cancel, suspend, and/or modify any one (1) or more of the voting methods for the Awards for any reason in Producer’s sole discretion, including, without limitation, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the voting process, as determined by Producer in its sole discretion; (ii) disqualify any individual Producer finds to be tampering with the voting process or to be acting in violation of these Rules or acting in an unsportsmanlike or disruptive manner; and/or (iii) to change these Rules at any time during the Voting Period and/or Turbo Voting Periods.  Any attempt by any person to deliberately undermine the legitimate operation of the voting process may be a violation of criminal and civil law. Should a person make such an attempt, Producer reserves the right to seek damages from such person to the fullest extent permitted by law.  Producer’s failure to enforce any provision of these Rules shall not constitute a waiver of that provision.

The interpretation and implementation of these Rules and any decisions or determinations made in connection with these Rules, the Awards and/or the Program shall be within the sole discretion of Producer. All such decisions and determinations by Producer shall be final and binding.

GOVERNING LAW; DISPUTE RESOLUTION: These Rules shall be governed by and enforced according to the laws of the State of California without regard to any rules relating to conflicts of laws. Except for Producer’s claims of infringement or misappropriation of Producer’s patent, copyright, trademark, or trade secret, any and all disputes arising under or related in any way to these Rules must be resolved through binding arbitration as described in this section. This agreement to arbitrate is intended to be interpreted broadly and includes, but is not limited to, all claims and disputes relating to the Rules, the Awards, the voting process and/or the Program. YOU AGREE THAT BY ENTERING INTO THIS AGREEMENT TO ARBITRATE, YOU AND PRODUCER ARE EACH WAIVING THE RIGHT TO TRIAL BY JURY OR TO PARTICIPATE IN A CLASS ACTION. YOU AND PRODUCER AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. ANY ARBITRATION WILL TAKE PLACE ON AN INDIVIDUAL BASIS; CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED. The arbitration will be conducted by JAMS in accordance with its then-current Streamlined Arbitration Rules and Procedures (“JAMS Rules”) and will be held in Los Angeles, CA. The arbitration will be conducted by one neutral arbitrator chosen by the parties. If the parties cannot agree upon an arbitrator, they shall submit to the procedure used by JAMS to choose an arbitrator. The current JAMS Rules may be found on the Internet at: http://www.jamsadr.com/rules-streamlined-arbitration/. This arbitration agreement is made pursuant to a transaction involving interstate commerce, and shall be governed by the Federal Arbitration Act (“FAA”), 9 U.S.C. §§1-16. The arbitrator shall apply California law, as described above, consistent with the FAA and applicable statutes of limitations, and shall honor claims of privilege recognized at law. Notwithstanding anything herein or in the JAMS Rules to the contrary, the arbitrator shall not have the power to award punitive damages against you or Producer. The arbitrator’s ruling is binding and may be entered as a judgment in any court of competent jurisdiction. In the event this agreement to arbitrate is held unenforceable by a court, then the disputes that would otherwise have been arbitrated shall be exclusively brought in the state or federal courts located in the City and County of Los Angeles, CA. Claims of infringement or misappropriation of Producer’s patent, copyright, trademark, or trade secret shall be exclusively brought in the state and federal courts located in the City and County of Los Angeles, CA.

Notwithstanding anything to the contrary herein, (a) you agree that your rights and remedies against Producer will be limited to the right, if any, to obtain damages at law, and you will not have any rights in such event to rescind these Rules or to enjoin or restrain the distribution, exhibition, or other exploitation of the Program, the Awards or any advertising, promotion, and/or publicity thereof, (b) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred but in no event shall include attorneys’ fees; and (c) under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim, indirect, punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and further waive any and all rights to have damages multiplied or otherwise increased.
